{"id":15109,"date":"2024-10-23T11:48:27","date_gmt":"2024-10-23T11:48:27","guid":{"rendered":"https:\/\/lonecandle.com\/?p=15109"},"modified":"2024-10-23T11:48:42","modified_gmt":"2024-10-23T11:48:42","slug":"how-would-a-second-trump-presidency-change-americas-courts","status":"publish","type":"post","link":"https:\/\/lonecandle.com\/?p=15109","title":{"rendered":"How would a second Trump presidency change America\u2019s courts?"},"content":{"rendered":"\n<p>&#8220;Since Trump\u2019s three appointees gave Republicans a supermajority on the Supreme Court, the Republican justices have behaved as though they are all&nbsp;<a href=\"https:\/\/www.vox.com\/scotus\/2023\/7\/8\/23784320\/supreme-court-2022-term-affirmative-action-religion-voting-rights-abortion\" target=\"_blank\" rel=\"noreferrer noopener\">going down a GOP wishlist<\/a>, abolishing the right to an abortion, implementing Republican priorities like a ban on affirmative action, and even holding that&nbsp;<a href=\"https:\/\/www.vox.com\/scotus\/358292\/supreme-court-trump-immunity-dictatorship\" target=\"_blank\" rel=\"noreferrer noopener\">Trump has broad immunity from prosecution<\/a>&nbsp;for crimes he committed using his official powers while in office. To be clear, right-wing litigants are not winning every case they bring before the justices, but on issues where the various factions within the Republican Party have reached consensus, the Republican justices&nbsp;<a href=\"https:\/\/www.vox.com\/scotus\/24117949\/supreme-court-republican-judges-fight-matthew-kacsmaryk-judge-shopping\" target=\"_blank\" rel=\"noreferrer noopener\">reliably align with that consensus<\/a>.<\/p>\n\n\n\n<p>The lower courts, meanwhile, have become incubators for far-right policy ideas that often go too far even for a majority of the members of the current Supreme Court. Think, for example, of Judge Matthew Kacsmaryk\u2019s&nbsp;<a href=\"https:\/\/www.vox.com\/scotus\/2024\/3\/21\/24105984\/supreme-court-mifepristone-abortion-pills-fda-alliance-hippocratic-medicine\" target=\"_blank\" rel=\"noreferrer noopener\">failed attempt to ban the abortion drug mifepristone<\/a>. Or an astonishing decision by three Trump judges that&nbsp;<a href=\"https:\/\/www.vox.com\/scotus\/2023\/9\/23\/23864355\/supreme-court-cfpb-unconstitutional-consumer-financial-fifth-circuit-great-depression\" target=\"_blank\" rel=\"noreferrer noopener\">declared the entire Consumer Financial Protection Bureau (CFPB) unconstitutional<\/a>. Both of these lower court decisions were rejected by the Supreme Court.<\/p>\n\n\n\n<p>That there are some positions too far right even for many Republican members of the Supreme Court is a reminder of the diversity that exists among Trump\u2019s judges. Some, like Justices Brett Kavanaugh or Amy Coney Barrett, are fully committed to using the courts to implement a long list of Republican ideas. But this cohort of judges also rejects at least some right-wing legal theories that would have catastrophic consequences for the country.<\/p>\n\n\n\n<p>Both Kavanaugh and Barrett, for example,&nbsp;<a href=\"https:\/\/www.vox.com\/scotus\/24158216\/supreme-court-cfpb-clarence-thomas-community-financial\" target=\"_blank\" rel=\"noreferrer noopener\">rejected the legal attack on the CFPB<\/a>. They joined an opinion explaining that the plaintiffs\u2019 legal theory had no basis in constitutional text or history, but they may also have been motivated by the fact that this theory&nbsp;<a href=\"https:\/\/www.vox.com\/scotus\/2023\/9\/23\/23864355\/supreme-court-cfpb-unconstitutional-consumer-financial-fifth-circuit-great-depression\" target=\"_blank\" rel=\"noreferrer noopener\">could have triggered an economic depression if it had prevailed<\/a>. Kavanaugh and Barrett also backed Trump\u2019s claim that he has broad immunity from criminal prosecution for crimes committed in office, but on the same day they rejected a Texas law that would have given that state\u2019s Republican legislature extraordinary authority to&nbsp;<a href=\"https:\/\/www.vox.com\/scotus\/358326\/supreme-court-netchoice-moody-paxton-first-amendment\" target=\"_blank\" rel=\"noreferrer noopener\">dictate what the media must print<\/a>.<\/p>\n\n\n\n<p>The other faction of Trump\u2019s judges is more nihilistic. They include Kacsmaryk, who has turned his Amarillo, Texas, courtroom into a&nbsp;<a href=\"https:\/\/www.vox.com\/policy-and-politics\/2022\/12\/17\/23512766\/supreme-court-matthew-kacsmaryk-judge-trump-abortion-immigration-birth-control\" target=\"_blank\" rel=\"noreferrer noopener\">printing press for court orders advancing far-right causes<\/a>.
