{"id":19636,"date":"2025-09-24T17:36:02","date_gmt":"2025-09-24T17:36:02","guid":{"rendered":"https:\/\/lonecandle.com\/?p=19636"},"modified":"2025-09-24T17:36:02","modified_gmt":"2025-09-24T17:36:02","slug":"the-perverse-incentives-for-snitch-tagging-teachers-who-criticized-charlie-kirk","status":"publish","type":"post","link":"https:\/\/lonecandle.com\/?p=19636","title":{"rendered":"The Perverse Incentives for Snitch-Tagging Teachers Who Criticized Charlie Kirk"},"content":{"rendered":"\n<p>&#8220;Public employees have robust protections against being fired for such speech, unless it proves exceptionally unpopular.<\/p>\n\n\n\n<p>This feature of First Amendment jurisprudence, and the bad incentives it creates for cancel culture campaigns, is on full display following the horrific assassination of Charlie Kirk last week&#8230;<\/p>\n\n\n\n<p>&nbsp;In a country where some&nbsp;<a href=\"https:\/\/www.nasra.org\/content.asp?contentid=181#:~:text=The%20BLS%20identifies%20approximately%2020.65,one%2Dquarter%20of%20the%20total.\" target=\"_blank\" rel=\"noreferrer noopener\">22 million civilians<\/a>&nbsp;are&nbsp;<a href=\"https:\/\/www.congress.gov\/crs-product\/R47716\" target=\"_blank\" rel=\"noreferrer noopener\">employed<\/a>&nbsp;by the government, the pool of people who&#8217;ve made nasty comments about Kirk naturally includes some public sector workers&#8230;<\/p>\n\n\n\n<p>At first blush, this would suggest that even government employees who explicitly praised Kirk&#8217;s assassination have First Amendment protections against being fired for that speech, however distasteful.<\/p>\n\n\n\n<p>Whether or not they can, in fact, be fired turns on how much their comments disrupt government operations.<\/p>\n\n\n\n<p>Consequently, the more outrage that can be directed at a particular public worker&#8217;s employer, and the more of a headache retaining that worker becomes as a result, the less the First Amendment will protect them from losing their job.<\/p>\n\n\n\n<p>&nbsp;That creates a powerful, toxic incentive to gin up anger at individual government workers as a means of erasing First Amendment protections they have for off-the-job speech&#8230;<\/p>\n\n\n\n<p>Kirk was undoubtedly a polarizing figure.
