The administration claims it was allowed to do under a statute permitting the Secretary of Defense to transfer military funds \u201c<a href=\"https:\/\/casetext.com\/case\/sierra-club-v-trump-1\" target=\"_blank\" rel=\"noreferrer noopener\">for higher priority items, based on unforeseen military requirements<\/a>.\u201d<\/p>\n\n\n\n<p>But, as several lower court judges have pointed out, there\u2019s nothing \u201cunforeseen\u201d about the circumstances that led Trump to build this wall. Trump\u2019s campaigned on plans to build a border wall&nbsp;<a href=\"https:\/\/www.vox.com\/2015\/8\/19\/9177419\/border-fence-work\" target=\"_blank\" rel=\"noreferrer noopener\">since 2015<\/a>. In late 2018 and early 2019, Trump even&nbsp;<a href=\"https:\/\/www.vox.com\/policy-and-politics\/2018\/12\/21\/18151974\/trump-border-wall-steel-slats-shutdown\" target=\"_blank\" rel=\"noreferrer noopener\">shut down much of the federal government<\/a>&nbsp;due to a disagreement over how much money should be appropriated to pay for the wall.<\/p>\n\n\n\n<p>So Congress did not deny Trump much of the funding he sought because it failed to foresee an emergent problem that could only be solved by a border wall.
