{"id":9073,"date":"2022-10-17T16:05:33","date_gmt":"2022-10-17T16:05:33","guid":{"rendered":"http:\/\/lonecandle.com\/?p=9073"},"modified":"2022-10-17T16:05:33","modified_gmt":"2022-10-17T16:05:33","slug":"courts-split-on-whether-the-feds-can-overturn-these-state-abortion-bans","status":"publish","type":"post","link":"https:\/\/lonecandle.com\/?p=9073","title":{"rendered":"Courts Split on Whether the Feds Can Overturn These State Abortion Bans"},"content":{"rendered":"\n<p>\n\n&#8220;&#8221;Federal law is clear: patients have the right to stabilizing hospital emergency room care no matter where they live,&#8221; said Department of Health and Human Services (DHS) Secretary Xavier Becerra. &#8220;Women should not have to be near death to get care.&#8221;<\/p>\n\n\n\n<p>In July,&nbsp;<a href=\"https:\/\/reason.com\/2022\/07\/12\/states-must-allow-abortions-when-womans-health-or-life-is-threatened-says-hhs\/\" target=\"_blank\" rel=\"noreferrer noopener\">HHS issued new guidance<\/a>&nbsp;stating that EMTALA&#8217;s provision for stabilizing treatment includes a right to an abortion in some circumstances. &#8220;If a state law prohibits abortion and does not include an exception for the health or life of the pregnant person\u2014or draws the exception more narrowly than EMTALA&#8217;s emergency medical condition definition\u2014that state law is preempted,&#8221; the agency&nbsp;<a href=\"https:\/\/www.hhs.gov\/about\/news\/2022\/07\/11\/following-president-bidens-executive-order-protect-access-reproductive-health-care-hhs-announces-guidance-clarify-that-emergency-medical-care-includes-abortion-services.html\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a>.<\/p>\n\n\n\n<p>No existing abortion ban lacks an exception for a mother&#8217;s&nbsp;<em>life<\/em>, but some do omit exceptions for women&#8217;s&nbsp;<em>health<\/em>. And determining whether something counts as a&nbsp;<em>life-threatening<\/em>&nbsp;emergency\u2014as opposed to a mere&nbsp;<em>health-threatening<\/em>&nbsp;emergency\u2014isn&#8217;t so clear-cut. Many pregnancy complications could become life-threatening while not being necessarily or immediately so. The&nbsp;<a href=\"https:\/\/www.cms.gov\/medicareprovider-enrollment-and-certificationsurveycertificationgeninfopolicy-and-memos-states-and\/reinforcement-emtala-obligations-specific-patients-who-are-pregnant-or-are-experiencing-pregnancy-0\" target=\"_blank\" rel=\"noreferrer noopener\">HHS guidance attempts<\/a>&nbsp;to provide clarity, stating that regardless of what a state law says, physicians must provide an abortion if one is necessary to address an emergency medical condition (including, but not limited to, ectopic pregnancy or severely high blood pressure).<\/p>\n\n\n\n<p>Texas&nbsp;<a href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/state\/2022\/07\/15\/paxton-sues-to-keep-emergency-rooms-from-providing-abortion-care\/65373641007\/\" target=\"_blank\" rel=\"noreferrer noopener\">sued over the HHS directive<\/a>.
