Biden’s Covid team grapples with a basic question: Where’s all the vaccine?

“Biden has made ending the pandemic a centerpiece of his early presidency, vowing an all-out federal effort to turn the tide of the crisis within the next several months.

But even as he signed a flurry of directives laying the foundation for that response, White House officials have sought to tamp down expectations — blaming the Trump administration for leaving behind a situation that they insisted was far worse than expected, despite months of transition meetings and planning.

“What we’re inheriting from the Trump administration is so much worse than we could have imagined,” Jeff Zients, Biden’s Covid-19 coordinator, told reporters Wednesday night. “We don’t have the visibility that we would hope to have into supply and allocations.”

Biden officials complained during the transition that their efforts to gather information on the coronavirus response were stymied at times by Trump administration political appointees. Biden aides for weeks were unable to access Tiberius, the central government database used to monitor vaccine distributions, according to one transition official. They were also denied access to certain standing meetings related to the government’s response until a few days before Biden was sworn in.

Yet while few disputed the transition was rocky, officials working on the transition or familiar with its work said it was patently obvious that the Trump administration response was severely lacking, and it should have been no surprise to Biden’s team.

That is particularly the case with the vaccine pipeline, which has been at the center of weeks of finger-pointing between states and the federal government over the slow pace of vaccinations.”

Liz Cheney’s problems pile up

“Liz Cheney was once considered the future of the GOP. Now she’s fighting to keep her political career alive.

After voting to impeach Donald Trump last week, the highest-ranking woman in the House GOP finds herself at risk of losing her leadership post; staring down a pro-Trump primary challenge; and censured by some of her own party back home in Wyoming.

The most immediate threat to Cheney — a push by Trump loyalists to oust her as conference chair — has gained momentum inside the House GOP, although the process is complicated and could still sputter out. But at least 107 Republicans, or just over a majority, have communicated to the leaders of that effort that they would support removing Cheney from leadership on a secret ballot, according to multiple GOP sources involved in the effort. Others are threatening to boycott future conference meetings if she remains in power.”

“If Cheney does lose her post, it will be the latest sign that the Trumpification of the Republican Party isn’t stopping anytime soon, even after the ex-president flew off to Mar-a-Lago with a disgraced legacy in Washington. Some say the Cheney fight has already become a proxy battle for the heart and soul of the splintered GOP.”

Biden is ending Trump’s travel ban

“The policy, colloquially known as the “Muslim ban,” first went into effect in January 2017 and became one of Trump’s signature immigration policies. The ban has slowed or altogether halted legal immigration from certain countries that the former administration deemed to be security threats, keeping families apart and even stymieing refugee resettlement.”

“The ban was amended several times in the face of numerous court challenges arguing that Trump did not have the legal authority to issue it and that it unlawfully discriminated against Muslims. The third version of the ban, ultimately upheld by the Supreme Court, barred citizens of seven countries — Iran, Libya, Somalia, Syria, Yemen, Venezuela, and North Korea — from obtaining any kind of visas, largely preventing them from entering the US. (Chad was taken off the list of countries subject to the ban in April 2019 after it met the Trump administration’s demands to share information with US authorities that could aid in efforts to vet foreigners.)
Trump expanded the ban last February to include additional restrictions on citizens of six more countries: Myanmar, Eritrea, Kyrgyzstan, Nigeria, Sudan, and Tanzania. While they could still visit the US, citizens of these countries were, for the most part, barred from settling in the US permanently.”

“The human cost of the travel ban has been devastating. Not only has the policy torn families apart, but it has also contributed to crises including doctor shortages in rural America and a dramatic drop in enrollment among foreign students from affected countries.

More than 41,000 people have been denied visas due to the ban. Citizens of any of the banned countries could qualify for a waiver that would grant them entry to the US if, for example, they needed urgent medical care or were trying to reunite with their immediate family in the US. But those waivers proved exceedingly difficult to obtain.

Data from the State Department suggests that fewer people have been applying for visas since the ban was enacted: In fiscal year 2019, immigration authorities granted about 39,000 visas to noncitizens from the original seven countries covered by the ban as compared to almost 338,000 just three years prior — about an 88 percent drop. Iran and Venezuela saw the biggest declines.”

“National security experts have argued that the suffering of those like Alghazzouli was largely in vain: The travel ban has not made America safer, despite the Trump administration’s arguments to the contrary.
The Trump administration claimed that all the affected countries pose threats to US national security based on the findings of multiple government agencies. But the agencies’ findings were never made public, meaning the nature of those threats remains unclear. The administration broadly cited terrorist activity, failure of the countries to properly document their own travelers, and insufficient efforts to cooperate and share information with US authorities as justification for the ban.

But dozens of former intelligence officials have opposed the ban. Elizabeth Neumann, a former assistant secretary for counterterrorism and threat prevention at the Homeland Security Department under the Trump administration, said in a press call earlier this month that the ban has hurt America’s relationships with foreign governments, which are critical to US national security interests. The US government should have worked with foreign governments to improve their own security procedures and information-sharing structures, without punishing them for not already being up to standard, she said.”

The US is back in the international climate game

“On Wednesday, Biden kicked off the process to undo Trump’s prolific environmental rollbacks — totaling nearly 100 during his presidency — and jump-start new climate regulation. One executive order covers a broad range of policies including methane regulations, energy efficiency standards for appliances, fuel efficiency standards for cars, and blocking the Keystone XL pipeline and drilling in the Arctic National Wildlife Refuge. It will take months for agencies to review and rescind Trump’s environmental decisions, but tackling all these regulations at once shows the new administration’s commitment to climate action.”

“The US will have to play catch-up once it rejoins the Paris agreement. Countries are supposed to impose stricter targets on themselves every five years, with the goal of limiting emissions to keep temperatures from rising more than 2 degrees Celsius compared to preindustrial levels. Several top emitters, including the European Union, submitted new targets on schedule last month, five years after the first round of targets in 2015.
Biden says he will reestablish the US as a global climate leader, implying that the US will set a new, ambitious 2030 target. But years of inaction under Trump have delayed US emissions reductions, making Biden’s job more difficult.”

There’s Still No Evidence Antifa Was Significantly Involved in the Capitol Riots

“Antifa is a real threat, and I’ve spent years documenting its illiberal activities. Most recently, antifa protested a book store for daring to sell a book by the antifa-critical writer Andy Ngo. (The predictable result of their efforts was that Ngo’s book surged to the top of the Amazon bestsellers list.)

But that doesn’t mean it’s fair to pin every example of mob violence on antifa. We know who caused the Capitol riots: supporters of the president who heard his call to protest the outcome of the 2020 election and took action.”

Will Joe Biden Destroy Trump’s Legacy of Deregulation?

“The guiding light of the Trump administration’s deregulatory efforts was Executive Order 13771. That 2017 order instituted the famous rule that regulators issue two deregulatory actions for every new regulatory action. It also created a system of accounting for the costs of new regulations and the cost savings of deregulatory actions. This was used to give federal departments regulatory budgets that limited the costs of new regulations they could impose, and often required them to find regulatory savings.
Using this measurement of regulatory savings, the Trump administration has been modestly successful at its goal of deregulating the economy, claiming $198 billion in eliminated regulatory costs. From fiscal years 2017–2019, the administration claims to have eliminated 3.6 rules for every new rule added. That ratio is 3.2 for fiscal year 2020.

Using other measurements, the Trump administration has been less successful. In some areas, they’ve done more to slow the growth of the administrative state without significantly reducing it. The length of the Code of Federal Regulations stayed essentially flat during Trump’s time in office, hovering at around 185,000 pages. The Mercatus Center’s tracker of restrictive words in the federal regulatory code comes to a similar result, finding that these words grew from 1.08 million at the beginning of Trump’s term to 1.09 million as of January 1, 2021.

Trump “leaves us with fewer regulations than Hillary Clinton would have—though not many fewer regulations than we had before,” summarizes Robert Verbruggen in a November National Review article.

One can expect this limited progress to be more than reversed under the new administration. Biden has already announced plans to reinstate Obama-era regulations that were pared back by the Trump administration.”

The ‘deep state’ of loyalists Trump is leaving behind for Biden

“A higher-than-usual number of Trump administration political appointees — some with highly partisan backgrounds — are currently “burrowing” into career positions throughout the federal government, moving from appointed positions into powerful career civil service roles, which come with job protections that will make it difficult for Biden to fire them.
While this happens to some degree in every presidential transition, and some political appointees make for perfectly capable public servants, Biden aides, lawmakers, labor groups and watchdog organizations are sounding the alarm — warning that in addition to standard burrowing, the Trump administration is leaning on a recent executive order to rush through dozens if not hundreds of these so-called “conversions.” The fear is that, once entrenched in these posts, the Trump bureaucrats could work from the inside to stymie Biden’s agenda, much of which depends on agency action.

The October executive order — which Biden is expected to swiftly rescind — has allowed federal agencies to help political appointees circumvent the usual merit-based application process for career civil service jobs, while moving career policymakers into a new job category with far fewer legal protections.

Thanks to weak transparency laws, the full impact of both changes may not be known for months.”

Trump’s New Citizenship Test Is Full of Conservative Bias—And Dotted With Mistakes

“December 1, 2020, the U.S. Citizenship and Immigration Service began administering a new naturalization test to those hoping to become U.S. citizens. The test draws from 128 potential civics questions, with the approved answers posted on the USCIS website. The test is given orally, and all applicants for naturalization will have to answer 20 of those questions chosen at random, with a passing score of 12.

When the test was first released a few weeks ago, many critics focused on its needless difficulty and complexity. The previous iteration of the test, last revised in 2008, required applicants to answer six of 10 questions, drawn from a pool of only 100. Several new questions call for biographical details about Alexander Hamilton, James Madison and Dwight Eisenhower, while another asks for “the purpose of the 10th Amendment.” Critics of the new test believe that it is intended to create an additional and unnecessary barrier to naturalization.

But perhaps the most significant feature of the test is its decidedly conservative political tilt, sometimes to the point of inaccuracy.

Certain questions, for example, reflect the Trump administration’s position in a case that is currently under Supreme Court review. Earlier this week, the court heard oral argument in a challenge to Trump’s unprecedented attempt to exclude unauthorized immigrants from the census count for the purpose of apportioning seats in the House of Representatives. All nine justices seemed fairly skeptical of Trump’s plan, with Justice Amy Coney Barrett observing that “a lot of the historical evidence and longstanding practice really cuts against [Trump’s] position.” After all, the 14th Amendment provides that representatives be apportioned according to “the whole number of persons in each State,” which has always previously been thought to mean exactly what it says.

We are unlikely to get a definitive answer from SCOTUS any time soon. (It appears probable that a host of complex procedural issues will send the case back to the lower courts for further consideration.) But fiddling with the census was not the Trump administration’s only opportunity to change our understanding of representation by limiting it to U.S. citizens. Here are two questions on the new naturalization test, as well as the only approved answers from the USCIS study guide, now embodying the Trump administration’s revisionist approach to government:

31. Who does a U.S. senator represent?

· Citizens of their state

33. Who does a member of the House of Representatives represent?

· Citizens in their [congressional] district

The acceptable answers have been changed from the 2008 iteration of the test, which accurately (at least for now, unless the Supreme Court decides otherwise) stated that U.S. senators represent “all people of the state.””

“The most recent time the test was revised, the Bush administration posted an advance “pilot” of 144 proposed questions, many of which included errors, omissions and shortcomings. The 100 questions that made the final cut corrected most of the mistakes—after I pointed them out in an article for Salon, although I have no way of knowing whether I actually deserve any credit. The Trump administration created no similar opportunity for correction, instead publishing an overtly partisan test that is sometimes just plain wrong.

Successful applicants will have studied hard to obtain their cherished U.S. citizenship, and it is a shame for USCIS to mislead them so badly about the nature of the government to which they will soon pledge allegiance.”

5 Profiles in Courage and Cowardice in a Trump-Dominated GOP

“Even before last week’s deadly invasion of the Capitol, McConnell, to his credit, forcefully rejected efforts to challenge duly certified electoral votes for Biden. “If this election were overturned by mere allegations from the losing side, our democracy would enter a death spiral,” he warned less than an hour before he was forced to flee the president’s enraged fans. “We would never see the whole nation accept an election again,” he added, and “every four years would be a scramble for power at all cost.”

Based on “sweeping conspiracy theories,” McConnell noted, “President Trump claims the election was stolen,” but “nothing before us proves illegality anywhere near the massive scale…that would have tipped the entire election.” He added that “public doubt alone” cannot “justify a radical break” from historical practice “when the doubt itself was incited without evidence.”

These were strong words, but they came two months too late. From the moment that Trump began insisting that he actually won the election by a landslide, it was clear that the president’s conviction had no basis in reality. Yet McConnell humored Trump, neither backing nor rejecting his wild claims, based on the premise that Biden’s victory should not be conceded until the president had exhausted his legal options and the Electoral College had met. In the meantime, the fantasy underlying last week’s riot grew and spread, unchallenged by all but a few Republican legislators.”

“Even McConnell and Pence are models of bravery compared to Sens. Ted Cruz (R–Texas) and Josh Hawley (R–Mo.), who led the legally groundless objections to Biden’s electoral votes in the Senate. In doing so, they cynically and recklessly reinforced the twin delusions that gave rise to last week’s violence: that Trump won the election and that Biden’s inauguration could still be prevented.

At the same time, neither Cruz nor Hawley had the guts to explicitly endorse those beliefs. They calculated that they could reap the political benefits of kowtowing to the president’s supporters without paying the political cost of looking like kooks. It apparently never entered the minds of these two Ivy League lawyers that they might pay a cost for so blatantly trying to advance their careers by sacrificing their supposed devotion to the Constitution. The crucial question for the Republican Party now is whether they were right to ignore that possibility.”

Rep. Liz Cheney has backed impeaching Trump — and even Mitch McConnell may be open to it

“Cheney is the highest-ranking Republican to commit to backing impeachment so far. In a scathing statement, she wrote that “the President of the United States summoned this mob, assembled the mob, and lit the flame of this attack. Everything that followed was his doing.”

Cheney’s statement continues: “The President could have immediately and forcefully intervened to stop the violence. He did not. There has never been a greater betrayal by a President of the United States of his office and his oath to the Constitution.”

Not long before Cheney’s statement, Rep. John Katko (NY) became the first elected Republican member of Congress to commit to backing this impeachment. “To allow the president of the United States to incite this attack without consequence is a direct threat to the future of our democracy,” Katko said in his own statement. “For that reason, I cannot sit by without taking action.” A third House Republican, Rep. Adam Kinzinger (IL), announced his support for impeachment, too.”
