Why every state is vulnerable to a Texas-style power crisis

“It’s not yet clear how many Texans died amid the cold, but several people died after they lost power, including an 11-year-old boy. Others died from carbon monoxide poisoning as they burned fuel indoors or ran their cars in desperate attempts to stay warm. Millions lost drinking water for days.

The blackouts cost the state economy upward of $130 billion in damages and losses, and some people who did have power saw their bills spike by thousands of dollars. Grid operators say that the situation could actually have been a lot worse, with the system minutes away from a monthslong blackout.

Texas politicians have not earned much sympathy from the ordeal. Texas Sen. Ted Cruz derided California’s “failed energy policies” when the Golden State suffered blackouts last year. Gov. Greg Abbott went on television to erroneously link the power outages to the Green New Deal. Other Texas politicos blamed iced-up wind turbines for the electricity shortfall when the majority of the power losses were from natural gas.

But this was a disaster that Texas should have seen coming. The state’s power grid has been creaking for years with underinvestment, despite previous winter outages, including one in 1989 and one in 2011 under very similar circumstances. And since 2011, the Texas population has grown by more than 4 million people to nearly 30 million residents, further increasing energy demand.”

“By now, the factors behind the Texas winter blackout are well-established: The coldest temperatures in 30 years triggered a sudden spike in wintertime energy demand, while the chilly weather led to coal piles freezing, a nuclear reactor tripping offline, and wind turbines icing up. Most importantly, the state’s largest source of electricity, natural gas, suffered shortfalls as wellheads froze, icy condensation blocked pipelines, and compressor stations shut down.

Much of the remaining gas was prioritized for heating rather than electricity. In total, about 34,000 megawatts of power generation shut down, more than 40 percent of peak winter demand.

Faced with such huge a mismatch between supply and demand, grid operators initiated blackouts to relieve the grid in the hope of staving off even more outages.”

“The Texas Public Utility Commission did issue guidance for making the state’s power grid more resilient to extreme weather, including severe cold, but the guidelines were voluntary and largely ignored.

Another issue for Texas is that the state’s electricity system is deregulated and almost entirely market-driven, unlike other states that have more specific rules about how the system should be run. In Texas, retail utilities buy electricity from power providers — companies that operate power plants — at fluctuating prices based on supply and demand and then sell them to customers.

The idea was that this would allow the power system to self-regulate and self-optimize while providing lower energy prices than a more regulated market. Periods of high electricity prices would spur generators to put more electrons on the grid and vice versa.

In practice, what this system meant was that when wind and solar power were abundant, they could undercut other power generators in price since wind and solar have no fuel cost and very low operating costs. Coal, nuclear, and gas power plants were then pushed to recoup their operating costs during periods of higher energy demand while also competing with each other, narrowing the windows where they could operate profitably. That left little incentive to build up extra electricity production capacity to deal with unexpected demand spikes or supply shortfalls.

“In fact, the incentives direct you to remove capacity from the market,” Hirs said. “If I add capacity to the market, I’m ensuring lower prices.”

The system worked when energy supply and demand followed predictable patterns. But when it deviated, like it did during Winter Storm Uri, it led to outages. As for customers, they ended up paying more. According to an analysis by the Wall Street Journal, Texas residential electricity customers under deregulated utilities paid $28 billion more than they would have under electricity rates charged by conventional regulated utilities in the state.

So the promise of greater reliability and lower costs did not materialize for millions of Texans under the state’s free-for-all, go-it-alone energy system. “This is a collision of naïve idealism and the real world,” Hirs said. ”

“While the Texas grid is unique in many respects, the problem of underinvestment in energy infrastructure is all too common throughout the US. Much of the power grid was built decades ago. In addition to the wear and tear that comes with age, the power grid is stressed by a growing population and its rising energy demands.”

“The broader problem is that every power system struggles to make the case to spend money on things that may never be used. The costs are upfront but the benefits are far away and theoretical. And that case doesn’t just have to be made to regulators, but to consumers.”

“Just like a blackout isn’t the result of any single point of failure, protecting the grid against them demands more than any single solution.

Faced with the prospect of more outages, there are a number of technical fixes: More energy storage, distributed power generation, interconnections across the major power grids, greater redundancy, microgrids, demand response, increasing energy efficiency, and hardening infrastructure.

But these things all cost money or eat into the margins of existing utilities. Trying to completely avoid all types of blackouts and grid disruptions stands to be prohibitively expensive, so part of the solution will also be managing failures and learning to bounce back after an outage.”

The controversy over Biden not holding a formal press conference, explained

“While he’s answered questions from reporters in informal settings numerous times and held a CNN town hall, Biden has now gone 50 days without holding a formal news conference. It’d be ideal for him to do one, but there are many good reasons he hasn’t yet — the urgent public health and economic crises he inherited, a pandemic that complicates logistics, and the legacy former President Donald Trump left him of presidential news conferences doubling as hate spectacles.

Still, it’s starting to aggravate members of the press corps, with the president of the White House Correspondents Association telling Vanity Fair that full press conferences are “critical to informing the American people and holding an administration accountable.” And the Washington Post editorial board wrote that “it’s past time for Biden to hold a news conference” — even while acknowledging that more press availability didn’t equal more truth or transparency with the previous president.

The careful wording of the Post’s editorial board exemplifies how journalists are having to reevaluate relationships to power and what it means to do adversarial journalism now that the White House isn’t the home of a habitual liar who routinely made reporters objects of hate, even while he was accessible to them with regular helicopter-side press availabilities and coronavirus press briefings that are best remembered for Trump floating the idea of disinfectant as a cure for Covid-19.

But on the cable network that benefited most from the Trump presidency, all of that nuance is lost.

Fox News has done its best in recent days to blow up the fact Biden hasn’t yet had a formal news conference into a major scandal, complete with special graphics and coverage across shows suggesting Biden is hiding something.”

“While it’s true that Biden has broken from modern precedent in not holding a news conference sometime in his first month in office, press secretary Jen Psaki answers questions from reporters every weekday during briefings that illustrate one of the reasons Biden might not be in a rush to do one himself.

Fox News’s Peter Doocy has distinguished himself during Psaki’s briefings by regularly asking loaded, gotcha-style questions on topics ranging from the national anthem to the Olympics to energy policy to school reopenings.”

Hannity says Biden should call Trump and thank him for his Covid-19 response. That’s a stretch.

“While Trump’s Operation Warp Speed program provided incentives for private companies to speed vaccine development and did directly help Moderna develop an effective vaccine, it’s not necessarily the case that vaccines wouldn’t be available today had it not been for Trump. The first FDA-approved coronavirus vaccine was developed by Pfizer last year without any direct help from the federal government.

To be clear — Trump deserves some credit for the fact that multiple vaccines were developed so quickly. As my colleague Dylan Scott reported last October, the federal government’s multibillion-dollar investment in helping companies like Moderna and Johnson & Johnson develop vaccines no doubt helped the country get to a point where there is finally some light at the end of the tunnel. Biden has acknowledged this, saying in December that “I think that the [Trump] administration deserves some credit, getting this [vaccine effort] off the ground, Operation Warp Speed.”

But vaccines don’t do much good if there’s no plan to get them into arms, and this is where Trump really fell short. As was the case when the US struggled to ramp up coronavirus testing infrastructure in the early days of the pandemic, the Trump administration’s plan for vaccine distribution did little more than pass the buck to under-resourced states. Trump’s failure to plan for the “last mile” resulted in episodes where unused vaccines were thrown out in the weeks before Biden took office.”

The megadrought parching 77 percent of the Western US, explained

“Over the past year, the drought has been building due to a lack of rain, a weak summer monsoon in the Southwest, and intense summer heat waves. “If I had to pinpoint one thing that really drove the drought to where we are right now, it was the heat of last summer,” said Brian Fuchs, a climatologist at the University of Nebraska’s National Drought Mitigation Center.

High summer temperatures sucked the moisture out of the soil and evaporated water resources.

The Four Corners, where Utah, Arizona, New Mexico, and Colorado meet, has been the epicenter of this drought, Fuchs said. The dark splotch on the map below shows that those states as well as Nevada have been experiencing the most intense drought.”

The growing number of children in custody on the US-Mexico border, explained

“Administration officials have urged patience as they review the dysfunctional system under which migrants are currently processed at the border, and as they seek to dismantle former President Donald Trump’s complex web of policies that put asylum and other humanitarian protections out of reach for most people. For now, that means that the vast majority of migrants are still being turned away.

Though the White House has declined so far to call it a “crisis,” the situation is increasingly dire: As of Wednesday, more than 3,700 children were reportedly being detained in Customs and Border Protection (CBP) temporary holding facilities designed for adults for longer than legally permitted — a record high. These are the same facilities that generated widespread outrage under the Trump administration, where children slept with nothing but mylar blankets to keep them warm at night on concrete floors.

Homeland Security Secretary Alejandro Mayorkas said Saturday that a CBP facility is “no place for a child,” but that border agents are “working around the clock in difficult circumstances to take care of children temporarily in our care.”

CBP officials are struggling to quickly transfer them to state-licensed shelters for migrant children, which have had to drastically slash their capacity amid the pandemic, and where beds are now full. That has forced the administration to reopen temporary tent facilities in Carrizo Springs, Texas, which are costly and not subject to the same level of oversight as permanent shelters.

On Saturday, the administration also announced that the Federal Emergency Management Agency would help “receive, shelter and transfer” unaccompanied children over the next 90 days. The agency is now working to expand the capacity of shelters designed to administer care to children.

If this sounds familiar, it’s because the same crisis has been playing out cyclically since at least 2014, when the US saw a dramatic shift in the kinds of migrants who were arriving at the southern border, from primarily single-adult Mexicans to families and children from Central America’s “Northern Triangle”: Guatemala, Honduras, and El Salvador.

In the years since, the federal government has failed to adapt to ensure that children and families are treated humanely. That burden is now on Biden.”

“While most migrants are still being turned away at the border, the Biden administration began accepting unaccompanied children in February in a reversal of Trump-era policy. Most of them have been stranded in Mexico for a year under that policy, despite their right to seek protection under federal law, and are now seeking to reunify with family in the US.

Since 2014, the number of unaccompanied children arriving at the southern border has remained above 40,000 annually, peaking at more than 72,000 in 2019 under Trump.”

“The administration also announced Wednesday that, in an effort to reduce the pressure on resources at the border, it is restarting the Central American Minors program, which allows children in danger to apply to come to the US from their home countries instead of having to come to the US-Mexico border to do so. Trump had ended the program after taking office, leaving around 3,000 children stranded who had already been approved for travel.”

“Biden has kept in place a Trump-era policy that has allowed the US to expel nearly all migrants arriving on the southern border with no due process on the grounds of curbing the spread of Covid-19.”

“Biden has created narrow exceptions to the policy for unaccompanied children and asylum seekers who were sent back to Mexico to await their day in court in the US under the Trump administration’s Migrant Protection Protocols. Last month, Mexico also stopped accepting some families with children under the age of 12 due to a change in its laws concerning the detention of children, so they have been released into the US instead.

But the vast majority of migrants still can’t enter the US under the policy.”

“the Biden administration’s message to migrants is, “The border is not open,” and “Do not come in an irregular fashion.” But there is hope among migrant communities in Mexico that the new administration will eventually offer them protection given that Biden has sought to pursue more immigrant-friendly policies than his predecessor.”

“Smugglers have also been spreading misinformation about the Biden administration’s plans to process asylum seekers in an effort to profit from it.”

Stimulus payments are already arriving. Americans say they really need them.

“Census Bureau Household Pulse study”

“Respondents were allowed to select more than one answer to the question, and most said the money would go to filling an essential need. The survey found about 60 percent of people planning to use at least some of their money on food, and about 45 percent planning to spend some or all the funds on housing — either rent or mortgages. Other bills were also a priority, with 45 percent saying the stimulus would help with utility payments, and about 31 percent wanting to put money toward credit cards or loans.

About 15 percent of respondents felt they might be able to save some or all of the money. Only 2.5 percent said some portion of the money would go toward recreational expenses.”

How Biden can claw back Trump’s influence on the courts

“It appears likely, moreover, that the GOP-controlled judiciary will be a thorn in Biden’s side. Trump-appointed Justice Neil Gorsuch, for example, is already laying the groundwork to strip federal agencies of much of their power to regulate after Biden takes office, and Gorsuch almost certainly has the five votes he needs to make this happen.

The Republican Party dominates the federal judiciary in no small part due to six years of work by outgoing Senate Majority Leader Mitch McConnell. When Justice Antonin Scalia died nearly a year before President Barack Obama left office, McConnell announced almost immediately that Obama’s Supreme Court nominee would get the cold shoulder from a Republican Senate. When Justice Ruth Bader Ginsburg died shortly before the 2020 election, McConnell ensured that her conservative replacement, Amy Coney Barrett, would be confirmed just days before the nation voted to cast Trump out of office.

During the final two years of Obama’s presidency — the only two years of his presidency that Republicans controlled the Senate — McConnell imposed a near-total blockade on new appointments to the federal courts of appeals (often referred to as “circuit” judges). The result was that now-outgoing President Donald Trump got to fill nearly all of the judicial vacancies that came open during his presidency, plus nearly all of the appellate court seats Obama should have filled in his final two years.

Although Obama served for twice as long as Trump, there are currently 53 active circuit judges appointed by Trump and only 50 appointed by Obama. (Obama’s judicial confirmations also got off to a fairly slow start, though they picked up considerably once the Senate changed its rules in 2013 to make it easier to confirm judges.)”

Trump is gone. But the threat of right-wing violence that arose under his watch remains.

“The most successful terrorist campaign in American political history took place after the Civil War.

Ex-Confederate soldiers and ordinary Southerners unwilling to give up on white supremacy formed a series of violent cells aimed at undermining Reconstruction. Their attacks, the most infamous of which were lynchings of recently freed Black people, aimed to disrupt racially egalitarian governments and impose costs on the North for continuing to occupy Southern land. The violence increased after Reconstruction ended, working to intimidate local Black populations while Southern states created new regimes that would render them second-class citizens.”

“We do not actually need a huge spike in far-right violence for it to be politically impactful. The mere threat of future violence can poison a democracy.”

“If more moderate Republicans are afraid to speak up, extremists will increasingly speak for the party. The more the extremists speak for the party, the more they will push Republicans voters to the far right and embolden violent far-right actors, further intimidating moderate voices from speaking out.

This is one key difference from the political dynamics of the 1970s. Back then, no significant faction of the Democratic Party was aligned with the violent radicals. Today, large sections of the far right see themselves as acting on behalf of or in conjunction with the Trumpist forces in the Republican Party. In footage of Capitol Hill mobbers ransacking the Senate floor, one attacker justifies his actions by saying “[Ted] Cruz would want us to do this.”

“There seem to be enough guns, political support, and rhetorical space to sustain at least some degree of mobilization by violence-curious radicals,” says Paul Staniland, a political scientist at the University of Chicago. “It’s a lot easier to unleash carnage than to pack it back away.””

It’s Time To Fix Green Card Quotas

“Current law caps the number of employment-based green cards that can be granted each year at 40,000. That is far fewer than the demand for green cards in that category. Making matters worse, nationals from any one country can be granted only 7 percent of the total.

As a result of that rule, a very small share of high-skilled professionals from India and China are able to land green cards even when their petitions have been approved. These two countries send America the bulk of our imported high-skilled talent, typically on H-1B visas. Meanwhile, the green card quotas for countries that don’t send much high-skilled talent to the U.S. go unfilled.

The upshot is that an estimated 800,000 immigrants who are working legally in the United States are waiting for green cards, an unprecedented backlog in employment-based immigration. The vast majority are Indians; Chinese are the next biggest category.

An Indian national who applies for a green card now might wait 50 years (or more) to get one. Under current policy, the Cato Institute’s David Bier estimates, 200,000 Indians will die of old age while waiting for green cards. The children of such workers qualify for dependent visas until they turn 21, at which point they become “legal Dreamers”—people who have grown up in this country but can’t qualify for permanent residence.”

Trump Promised a ‘Good and Easy To Win’ Trade War, Then Lost It

“President Donald Trump’s declaration on March 2, 2018, that a trade war with China would be “good and easy to win” remains one of the defining moments of his four years in the White House.

That’s only because of how wrong the claim turned out to be. It deserves to live on in infamy alongside George W. Bush’s “mission accomplished” speech and Barack Obama’s “if you like your doctor, you can keep your doctor” promise. Like those, it oversold a complex, messy policy as simple and straightforward. Trump naturally took that presidential hubris to another level, and he paired it with unprecedented policy naivety. If winning a trade war were as simple as tweeting victory into existence with fake statistics, faulty economics, and the veneer of toughness, Trump likely would have succeeded. Unfortunately, that didn’t work.”

“Trump deserves some credit for reorienting America’s economic and foreign policies to recognize the threat posed by the Chinese Communist Party to freedom around the world. But his approach—which amounted to little more than levying higher taxes on $460 billion of imports and forcing Americans to foot the bill—was an abject failure.”

“China, of course, did retaliate. It drastically reduced agricultural imports from the United States. In 2017, the last year before the trade war began, China imported more than $19 billion in American farm goods, which fell to $9 billion in 2018 and rebounded weakly to $13 billion in 2019. Exports to other countries have been unable to make up the difference, leaving American farmers in the lurch.

The Trump administration responded by spending more than $28 billion in new farm subsidies to mitigate the totally predictable mess it made. By the end of 2020, federal payments accounted for one-third of all American farm income—as Trump’s trade war bailout was piled atop existing subsidies. Rolling back those payments will be politically difficult for future administrations, so they might be here to stay.”

“During his first week in office, Trump signed an executive order withdrawing the United States from the Trans-Pacific Partnership (TPP), a proposed 12-nation trade agreement that was a work-in-progress holdover from the Obama administration. In 2018, Trump launched his trade war by nonsensically declaring that steel and aluminum imports from places like Canada and Europe were somehow threats to U.S. national security.

All of that made a difficult confrontation with China more complicated than it otherwise would have been. A go-it-alone strategy was meant to project America’s toughness but a multilateral approach that lowered tariffs on imports from countries that compete with China would have been more effective.

Ironically, Trump also left America less capable of standing up to China in other ways—the president was reportedly hesitant to condemn China’s takeover of Hong Kong and was unwilling to speak out against China’s abuse of Uighurs because doing so might hurt trade negotiations.”
