Cops at the schoolyard gate

“School resource officers appear in all 50 states. They are visible in both urban meccas and small towns. In 1975, only 1 percent of US schools reported having police stationed on campus. By the 2017–18 school year, 36 percent of elementary schools, 67.6 percent of middle schools, and 72 percent of high schools reported having sworn officers on campus routinely carrying a firearm. In raw numbers, there were 9,400 school resource officers in 1997. By 2016, there were at least 27,000.

Because police operate under many different titles in schools, these numbers are surely low. Tallies often miss private security guards and neighborhood officers assigned by the local police department to patrol several schools without any formal agreement with the school district.”

“Even when school resource officers are expressly hired to respond to emergencies and protect students from guns and serious threats of violence, they are quickly drawn into the more routine activities of law enforcement on campus. Forty-one percent of school resource officers surveyed in 2018 reported that “enforcing laws” was their primary role on campus. Police often arrive with little or no training on how their traditional law enforcement roles should differ within the school context and even less training on developmental psychology and adolescent brain development.”

“Ultimately, more police in schools means more arrests — three and a half times more arrests than in schools without police. And it means more arrests for minor infractions that teachers and principals used to handle on their own.

When I was in high school in the mid-1980s, we were sent to the principal’s office when we acted out. Sometimes we had to stay after school for detention. I even got suspended once for “play fighting” with one of my classmates, but I was never arrested. Today, children get arrested regularly at school, and mostly for things kids do all the time: fighting or threatening a classmate, breaking a window in anger, vandalism and graffiti, having weed, taking something from someone on a dare, arguing in the hallway when they are supposed to be in class.”

“The US could soon be facing dual migrant crises stemming from unrest in Haiti and Cuba. In response, the Biden administration has preemptively warned migrants not to try to come to the US by boat.

Homeland Security Secretary Alejandro Mayorkas recently confirmed that any migrants intercepted by the US Coast Guard off US shores will not be allowed to enter the country — they will be turned back or, if they express fear of returning to their home countries, repatriated to a third country.

“The time is never right to attempt migration by sea,” Mayorkas said in a press conference earlier this month. “To those who risk their lives doing so, this risk is not worth taking. Allow me to be clear: If you take to the sea, you will not come to the United States.”

The policy isn’t new. Past administrations, both Republican and Democratic, have employed this interdiction approach to prevent Caribbean migrants from reaching US shores. But although it was always done under the pretense of protecting migrants from the very real dangers of that journey, it resulted in many Haitians being returned to certain peril in their home country over the years and, under the administrations of Presidents George H.W. Bush and Bill Clinton, languishing in what one federal judge called a “prison camp” at Guantanamo Bay, Cuba, where they were held after being intercepted at sea.”

“The vast majority of migrants who passed through Guantanamo were returned to Haiti. A much smaller percentage were able to be paroled into the United States because they passed their asylum interviews.”

How to make the child tax credit more accessible

“The first of the 2021 child tax credits hit parents’ bank accounts in July — but not for everyone. For many of the parents who need it most, accessing the money may be more of a struggle.
That’s because the IRS — an agency that knows little about the lowest-income Americans, who often don’t file taxes — has been tasked with distributing the money, up to $300 per month per child.

On July 15, the day payments first went out, the IRS said it sent $15 billion to 35 million families, 86 percent of which was sent via direct deposit. That suggests that the vast majority of initial recipients were from families who earned income and filed taxes, many of them middle- or lower-middle-income parents whose names, addresses, and bank accounts are on file from tax returns.

More than 10 million children live in poverty, according to 2019 data from the US Census. Of those, the People’s Policy Project estimates that about 7 million live in non-filing households. (Because these families are, by definition, somewhat difficult to track, estimates vary: The Census Bureau says that 36 percent of children in poverty are from families that did not file taxes in 2019, including 55 percent of children in families in deep poverty.)

Most of these families haven’t signed up to get government stimulus checks, either, effectively leaving thousands of dollars from the government on the table over the past year. The IRS gathered information on an additional 720,000 children in non-filing households where the parents registered to receive stimulus payments.

But that still leaves millions of children whose parents are eligible for the child tax credit (CTC) but who are not on track to receive it.”

Abortion Ban To Take Effect in Texas on Wednesday

“Passed in May, the law makes it illegal to perform an abortion once fetal cardiac activity is detected. That starts six weeks into pregnancy, and about two weeks after a woman can tell she is pregnant.

What makes the measure (Senate Bill 8) more novel—and extreme—is that it also lets anyone (even people outside the state) sue anyone they think has violated the law by performing a prohibited abortion or aiding and abetting the provision of an illegal abortion. Among other things, aiding and abetting here includes “paying for or reimbursing the costs of an abortion through insurance or otherwise,” the law states.”

Democrats embrace ‘cook-the-books’ tactic they bashed under Republican reign

“It’s an imperfect science, indeed. Under the gambit, budget forecasters estimate how much a policy change might boost the economy and send more cash flowing to the federal government. This time, Democrats are pinning their revenue hopes on the idea that major investments in the social safety net, climate policy and tax reform will yield robust, long-term economic growth.

“I’m very concerned that the pay-fors aren’t real,” said Sen. Rand Paul (R-Ky.), a fiscal conservative. “Both parties bear some culpability. But I’m worried about adding so much debt in such a short period of time.”

Both Democrats and Republicans have previously relied on dynamic scoring and both have lampooned its use as a budget trick. Predictions about how much revenue a new government policy will generate are often exaggerated or inaccurate and are difficult to calculate, placing enormous pressure on independent budget analysts to come up with favorable numbers that might turn out to be a bust.”

Murders are up. Crime is not. What’s going on?

“The increase in murder appears to be a uniquely American phenomenon. While murder rates rose in some developed countries last year, like Canada and Germany, the increases are far below the double-digit spikes America is seeing. That’s especially notable because the United States already had a higher baseline of murders, after controlling for population. Despite claims that Democratic mayors or progressive criminal justice policies are driving the increase, it also appears indifferent to the political party in charge: As Asher and criminal justice expert John Pfaff have shown, murder rates increased in cities run by Democrats and Republicans, progressive and not.

The good news is there is a lot more agreement among experts about how to bring down the spike than there is about what caused it. But the best evidence suggests stopping murders in the short term will require more and better, though not necessarily more aggressive, policing — a controversial proposal on the left.

“I know people don’t want to hear this, and I empathize with that,” Anna Harvey, a public safety expert at New York University, told me. “But at least as far as the research evidence goes, for short-term responses to increases in homicides, the evidence is strongest for the police-based solutions.”

The stakes are very high. Nearly 21,000 people were murdered in America in 2020, based on preliminary data. Another increase of 10 percent or more could mean thousands more dead in 2021.”

“Some other kinds of crime also increased, according to this early data, including shootings, aggravated assaults, and car thefts. Still, violent crime in general went up at much lower rates, if at all, compared to murders, and overall crime declined, driven in part by a drop in the majority of property crimes.”

“The closest to a consensus I’ve been able to find in talking to experts about the cause of the murder spike: It’s complicated.
Experts have rejected some possibilities. Given that murders rose in both Democrat- and Republican-run cities, as well as places that adopted criminal justice reforms and those that didn’t, partisanship and criminal justice reforms don’t seem to be a cause.

Three plausible explanations, none of which exclude the others, have come up repeatedly:”

“The pandemic shut down programs that likely safeguard Americans from violence, including policing, social services, and community-led efforts. It left some people, particularly teen boys and young men, with more free time to stew over interpersonal conflict as workplaces and schools shut down. And it fed a general sense of chaos and despair throughout the year, perhaps amplifying perceptions that desperate times can call for desperate measures.

But much of the world also struggled with Covid-19, from Mexico to Canada to much of Europe, and didn’t see double-digit percent increases in murders last year. That suggests the virus can’t be the sole cause.”

“One theory held that officers, afraid of getting caught in the next viral moment that leads to protests, backed off from proactive policing. On the other side, the public could have lost trust in police and been less likely to cooperate as witnesses or informers, making it harder to close cases, make arrests, and get dangerous people off the streets. A greater sense that the criminal justice system can’t be trusted also could have led people to take matters, violently, into their own hands.”

“The US has the most number of guns in civilian hands, and the last year saw a huge spike in the number of firearms purchased by Americans. The research is clear here: More guns mean more gun violence — and more deadly violence, because the presence of a gun allows just about any conflict, from public arguments to domestic abuse, to escalate.”

“Even if new gun purchases weren’t to blame, it’s possible existing guns are: Asher found evidence that more people were carrying guns last year, leading to more police finding guns in the course of an arrest. So perhaps it’s not so much that people bought new firearms but that they started carrying the arsenal of weapons they already had.

Perhaps the best explanation: All of these factors played a role.

There are many ways all these explanations could have interacted. As one example: Covid-19 and protests both fueled a sense that the social fabric was unraveling, and more people — particularly in the worst-off neighborhoods — felt they had to fend for themselves. They equipped themselves with guns to act on their own if they felt a threat. And this made any given conflict more likely to escalate to deadly violence.

Ultimately, though, there are too many unknowns to draw hard conclusions.”

“there’s strong evidence that more police lead to fewer homicides, and solid research backs strategies like hot spot policing and problem-oriented policing.

These strategies tend to be more focused, like hot spot policing’s heightened surveillance of very specific high-crime blocks. Or they tend to be more planned: Problem-oriented policing requires formal evaluations of a problem and solutions, and calls for bringing in community partners to make sure the issue is addressed at its root. It’s a shift from dragnet efforts in which officers target entire neighborhoods to stop or arrest as many people as possible.

In fact, these approaches can actually reduce overall incarceration. For example, the evidence for hot spot policing suggests that officers’ mere presence deters crime, since people are less likely to do illegal things in front of a cop. Police don’t have to do anything — just stand there and watch. And fewer crimes committed means fewer arrests.”

“There’s good evidence for providing summer jobs programs, raising the age to drop out of school, greening vacant lots, installing more streetlights, providing more drug addiction treatment, implementing better gun control, and raising the alcohol tax, among other ideas.

The problem, experts told me, is that even the effective non-police strategies tend to take time to work. Police can be active on a high-crime block in minutes, but it can require years to lift up people and neighborhoods, economically and otherwise, and address root causes of crime that these alternatives are supposed to target. They aren’t all designed to reduce the number of murders quickly.

“It doesn’t mean police are a panacea for these things,” Williams said. “But it does mean we should be very careful about throwing around interventions that we don’t necessarily know come with any important benefits or costs.””

Don’t worry about inflation

“the biggest price increases affecting “core” non-gas or food inflation in recent months have come from new and used cars and air travel. The Biden Council of Economic Advisers estimates that at least 60 percent of inflation in June was due to car prices alone, and a big chunk of the rest came from services like air travel increasing in price as everyone rushes back to travel post-pandemic.

A huge part of the rise in car prices is a semiconductor shortage — implying that a better way to tackle inflation than the Fed raising interest rates might be an effort to improve supply of semiconductors, including boosting production in the US. Biden’s recent efforts to get Taiwan to boost production for US car companies is exactly the kind of intervention implied by this analysis.

The Fed itself seems to be thinking this way; Powell recently testified to Congress that “supply constraints have been restraining activity in some industries, most notably in the motor vehicle industry, where the worldwide shortage of semiconductors has sharply curtailed production so far this year.” Lael Brainard, an influential member of the Fed’s Board of Governors, has said the same.

“If you do think that this supply side story is convincing, then that does really change the way you want to think about this,” Steinsson told me. “Somebody’s going to build a new semiconductor factory at some point … that gives you a rationale for not using the blunt tool of raising interest rates for the whole economy.”

Yes, inflation is rising, there is a great deal of uncertainty, and the specter of the ’70s looms large. But given how much economic pain was visited on millions in the fight against inflation decades ago, it’s encouraging that today’s policymakers seem more willing to consider the path their predecessors did not take.”

How America lost its commitment to the right to vote

“The Voting Rights Act is arguably the most successful civil rights law in American history. Originally signed in 1965, it was the United States’ first serious attempt since Reconstruction to build a multiracial democracy — and it worked. Just two years after President Lyndon Johnson signed the Voting Rights Act into law, Black voter registration rates in the Jim Crow stronghold of Mississippi skyrocketed from 6.7 percent to nearly 60 percent.

And yet, in a trio of cases — Shelby County v. Holder (2013), Abbott v. Perez (2018), and Brnovich v. DNC (2021) — the Court drained nearly all of the life out of this landmark statute. After Brnovich, the decision that inspired Kagan’s statement that the Court has treated the Voting Rights Act worse than any other federal law, it’s unclear whether the Supreme Court would rule in favor of voting rights plaintiffs even if a state legislature tried to outright rig an election.

These cases are the culmination of more than half a century of efforts by conservatives who, after failing to convince elected lawmakers to weaken voting rights, turned to an unelected judiciary to enact a policy that would never have made it through Congress. All of this is bad news for minority voters in America, who are most likely to be disadvantaged by many of the new restrictions currently being pushed in statehouses across America, and for the country’s relatively young commitment to multiracial democracy. And there are at least three reasons to fear that decisions like Shelby County and Brnovich foreshadow even more aggressive attacks on the right to vote.”

“Georgia recently enacted a law that effectively enables the state Republican Party to disqualify voters and shut down polling precincts. If the state GOP wields this law to close down most of the polling places in the highly Democratic, majority-Black city of Atlanta, it’s unclear that a Voting Rights Act that’s been gravely wounded by three Supreme Court decisions remains vibrant enough to block them.”

“The impact of Shelby County was fairly swift. In 2013, for example, Texas enacted racially gerrymandered legislative maps, even though a federal court had rejected many key elements of these maps under the Voting Rights Act’s preclearance provisions. Yet, with preclearance dead, the Supreme Court upheld nearly all of Texas’s gerrymandered maps in Abbott v. Perez (2018).

Similarly, if preclearance were still in effect, it is unlikely that many of the controversial provisions of Georgia’s recently enacted voter suppression law would survive. And certainly no federal official acting in good faith would permit Georgia to simply start closing down polling places in Black neighborhoods.”

“The biggest uncertainty surrounding the Court’s voting rights decisions, in other words, is whether the Court will enable efforts to lock Republicans into power no matter what voters do to elect their candidates of choice, or whether the Court’s majority will, at some point, tell their fellow Republicans in state legislatures that they’ve gone too far.

The answers to these questions, moreover, won’t be found anywhere in the Constitution, or in any law enacted by Congress. The Roberts Court’s voting rights cases bear far more resemblance to the old English common law, a web of entirely judge-created legal rules governing areas such as contracting and property rights, than they do to the modern, more democratic model where federal judges are supposed to root their decisions in legal texts. The future of democracy in the United States will be decided by six Republican-appointed justices’ arbitrary whims.

And, if a majority of the justices do support a wholesale attack on liberal democracy, their actions will hardly be unprecedented.

Nearly a century before President Lyndon Johnson signed the Voting Rights Act, Congress and state legislatures passed a different kind of legislation that was supposed to guarantee the franchise to people of color.

It’s called the 15th Amendment, with its command that “the right of citizens of the United States to vote shall not be denied or abridged by the United States or by any State on account of race, color, or previous condition of servitude.”

The pre-Voting Rights Act United States did not deny voting rights to millions of African Americans because we lacked a legal guarantee protecting the right to vote. We did so because powerful public officials — including judges — decided that they did not care what the Constitution had to say about voting rights.

We’re about to find out whether the Supreme Court is going to repeat that history.”
