Trump Asks Supreme Court To Bless Racial Profiling by Immigration Agents

“Noem v. Perdomo is not a normal case. Instead of disavowing the apparently unconstitutional behavior at its core, the Trump administration is openly embracing that behavior and urging the justices of the U.S. Supreme Court to do the same. It is the rare case in which both the government and its opponents agree that federal agents behaved in a specific way; the two sides only disagree about whether the specific behavior should count as good or bad.

…

according to the emergency application to SCOTUS signed by Solicitor General John Sauer, “apparent ethnicity can be a factor supporting reasonable suspicion in appropriate circumstances.” Translation: If a federal agent thinks that someone “looks illegal,” the agent should be free to seize that person based only on his “apparent ethnicity” without setting off any sort of Fourth Amendment alarm bells.

Furthermore, in response to the argument that the federal government’s alleged racial profiling has resulted in an overly broad dragnet that inevitably ensnares innocent U.S. citizens, the Trump administration told the Supreme Court that “the high prevalence of illegal aliens should enable agents to stop a relatively broad range of individuals.”

Take a moment to let that sink in. The Trump administration wants the Supreme Court to give its blessing to a kind of systematic racial profiling that involves federal agents stopping a “broad range of individuals” based exclusively on factors such as the individuals’ “apparent ethnicity.” And if the rights of U.S. citizens—such as the Fourth Amendment right to be free from unreasonable searches and seizures regardless of your skin color—happen to get trampled along the way, the Trump administration’s message to those victimized citizens is this: tough luck.”

Supreme Court Rules, Again, That Different Standards for Discrimination Plaintiffs Are Unconstitutional

“the Supreme Court unanimously ruled in favor of a teenage girl and her parents who are attempting to sue the girl’s school district for alleged disability discrimination. The decision, which did not rule on the merits of the case, is similar to another recent unanimous ruling finding that courts cannot require different discrimination cases to meet different standards of proof to receive a favorable judgment.”

…

“two lower courts ruled against the family. The 8th Circuit ruled that simply failing to provide A. J. T. a reasonable accommodation wasn’t enough to prove illegal discrimination. Rather, because the family was suing a school, they would be subject to a higher standard than plaintiffs suing other institutions. The family was told they had to prove that the school’s behavior rose to the level of “bad faith” or “gross misjudgment.”

The Supreme Court disagreed. In the Court’s opinion, Chief Justice John Roberts wrote that disability discrimination “claims based on educational services should be subject to the same standards that apply in other disability discrimination contexts,” adding that “Nothing in the text of Title II of the ADA or Section 504 of the Rehabilitation Act suggests that such claims should be subject to a distinct, more demanding analysis.”

In a concurring opinion, Justice Sonia Sotomayor reiterated how nonsensical the 8th Circuit’s higher standard for educational disability discrimination claims was, noting that some of the most obvious forms of disability discrimination do not involve bad faith or misjudgment against the disabled.”

‘I’m Being Kicked Out’: A Trans Military Commander Confronts Trump’s Ban

“Recent figures from the Defense Department reported 4,240 — or 0.2 percent — of about 2 million service members have been diagnosed with gender dysphoria. Data from previous years by advocacy groups has calculated the number to be much higher, at around 15,000.

…

Trump unveiled the plan in an executive order on inauguration day. The basis for the order, which Trump also enacted during his first term, is the argument that gender dysphoria is incompatible with military service.”

A Ruling Against Mahmoud Khalil Highlights Marco Rubio’s Vast Power To Deport People for Their Opinions

“In general, a foreign national is neither excludable nor deportable “because of the alien’s past, current, or expected beliefs, statements, or associations, if such beliefs, statements, or associations would be lawful within the United States.” But the INA makes an exception when “the Secretary of State personally determines that the alien’s admission would compromise a compelling United States foreign policy interest.” The only statutory requirement to invoke that exception is that the secretary of state “has reasonable ground to believe” that someone’s “presence or activities” would “have potentially serious adverse foreign policy consequences for the United States.””

…

“Giving “a single government official sweeping and nearly unchecked power to pick and choose individuals to deport based on beliefs alone, without alleging a single crime, crosses a line that should never be crossed in a free society,” Creeley said. “The only ‘crime’ the government has offered [is] that Mahmoud Khalil expressed a disfavored political opinion. If that’s a crime in America, every single one of us is guilty.””

Trump signs 4 new executive orders, transforming military

“The new orders prevent transgender people from openly serving in the military, greenlight the process of developing a missile defense shield to protect the U.S., and reinstate service members that voluntarily left or were forced out of the military over COVID-19 vaccine mandates.

Trump also penned an expected executive order that would “abolish” every diversity, equity and inclusion (DEI) office within the DOD and Department of Homeland Security, the latter of which houses the U.S. Coast Guard.”

Laura Loomer, Trump’s new favorite conspiracy theorist, explained

“Loomer has been a quasi-journalist on the fringe right for about a decade, with a penchant for saying things that make even hardened MAGA types recoil. She is a self-described “proud Islamophobe” who has cheered the deaths of migrants and called for Muslims to be banned from driving for ride-hail apps. She ran for Congress twice, in 2020 and 2022, and failed both times. More recently, Loomer has called Kamala Harris a “drug-using prostitute” and warned that, if she wins, “the White House will smell like curry & White House speeches will be facilitated via a call center.”
Despite all of this, Trump has long displayed a soft spot for Loomer. He endorsed her House bid in 2020 and, in 2023, tried to offer her a spot on his campaign — only to back down after aides revolted. Undeterred, he hosted her at Mar-a-Lago afterward, repeatedly boosted her content on Truth Social, and traveled with her on the 2024 campaign trail.

It’s not clear what Trump gets out of this relationship. But his ties to Loomer have become a major controversy since the 9/11 event, with some of the former president’s closest allies speaking publicly against Loomer.

“The history of this person is just really toxic,” Sen. Lindsey Graham (R-SC) told the HuffPost. Rep. Marjorie Taylor Greene (R-GA) — who claimed a Jewish family was using space lasers to start wildfires! — thinks Loomer is a bridge too far, calling Loomer’s tweet about Harris and curry “appalling and extremely racist.” (Loomer responded by accusing Greene of sleeping with a “Zangief cosplayer.”)

It’s hard to take these condemnations all that seriously. Trump and his vice presidential pick have spent this week pushing a nasty conspiracy theory about Haitian immigrants stealing and eating people’s pets that appears to have inspired real-world hate crimes. If you’re worried about racism and conspiracy theorizing, maybe take a look at the top of the ticket.

But what makes Loomer different from Trump is that she has literally no filter. She says the quiet part out loud, every single time. The more time Trump spends with her, the harder it is to deny that his thinly veiled bigotry is anything but the genuine article. And that, for the Republican Party, is a very big problem indeed.”
