Judge strikes down Arkansas ban on gender-affirming care for transgender minors

“A federal judge struck down Arkansas’ first-in-the-nation ban on gender-affirming care for children as unconstitutional.., the first ruling to overturn such a prohibition as a growing number of Republican-led states adopt similar restrictions.
U.S. District Judge Jay Moody issued a permanent injunction against the Arkansas law, which would have prohibited doctors from providing gender-affirming hormone treatment, puberty blockers or surgery to anyone under 18.”

“Moody ruled that the prohibition violated the due process and equal protection rights of transgender youth and families. He said the law also violated the First Amendment rights of medical providers by prohibiting them from referring patients elsewhere.

“Rather than protecting children or safeguarding medical ethics, the evidence showed that the prohibited medical care improves the mental health and well-being of patients and that, by prohibiting it, the state undermined the interests it claims to be advancing,” Moody wrote in his ruling.”

“The ruling affects only the Arkansas ban but may carry implications for the fates of similar prohibitions, or discourage attempts to enact them, in other states.”

Federal judge rips into Florida’s ban on gender-affirming care for kids

“A federal judge delivered a stinging rebuke to Florida Gov. Ron DeSantis and the Republican-controlled Legislature over rules and a new state law that banned minors from receiving “puberty blockers” and other types of gender-affirming care.
U.S. District Judge Robert Hinkle on Tuesday blocked the state from applying the ban to three minors whose parents are part of an ongoing lawsuit, saying they would “suffer irreparable harm” if they were not allowed to continue access to hormones and other types of treatment.”

“The American Academy of Pediatrics and the American Medical Association support gender-affirming care for adults and adolescents. But medical experts said gender-affirming care for children rarely, if ever, includes surgery. Instead, doctors are more likely to recommend counseling, social transitioning and hormone replacement therapy.”

When State Law Defines ‘Man’ And ‘Woman,’ Who Gets Left Out?

“intersex is actually an umbrella that covers four parts of human biology: chromosomes, those X’s and Y’s that carry genetic information; gonads, the organs that produce eggs or sperm; the mixture of hormones coursing through a person’s veins; and what their genitalia looks like. An intersex person might have differences in one of these areas, or all of them.”

“Not only is gender a spectrum, but actual physical, biological sex is a spectrum … And so it’s impossible to fit these bodies into a single box.”

“Wong says it’s hard to know for sure what the rate of intersex traits are because there are so many differences that could be counted and because some differences go unnoticed without genetic testing — which most Americans never do. But she and Fraser worry that these laws could mandate that kind of test, say for participation in sports.”

Florida Bans Most Public School Instruction on Sexual Orientation and Gender Identity

“The Florida Board of Education voted..to approve proposed regulations that will prohibit teachers from providing instruction on sexual orientation and gender identity in most classes in any grade of its public schools, expanding censorship of LGBT issues far beyond the stated goals of conservative politicians that they wanted only to protect very young children from overly sexualized discussions.

When Republican Florida lawmakers introduced and passed H.B. 1557, opponents quickly started calling it a “Don’t Say Gay” law. Florida Gov. Ron DeSantis shot back that the law was only for kindergarten through third grade, even sparring with a reporter at a press conference about the text of the law. He subsequently used a clip of that response in a self-promoting video.

DeSantis’ response now looks like misleading nonsense. The law not only banned discussion of sexual orientation and gender through third grade, but it also contained an additional prohibition on any such instruction in a grade where it “is not age-appropriate or developmentally appropriate for students.” The law did not define these terms, leaving it to the state’s Board of Education. That board has decided that almost all discussion of these issues is inappropriate in public schools.

The Miami Herald reports that the board voted..to approve a proposed rule that states that teachers “shall not intentionally provide classroom instruction to students in grades 4 through 12 on sexual orientation or gender identity unless such instruction is either expressly required by state academic standards … or is part of a reproductive health course or health lesson for which a student’s parent has the option to have his or her student not attend.””

Indiana governor signs ban on gender-affirming care

“Indiana’s governor signed a bill banning all gender-affirming care for minors…joining at least 12 other states that have enacted laws restricting or banning such care.”

“Opponents of the legislation said the types of care the bill would ban, such as hormone therapy and puberty blockers, are vital and often life-saving for transgender kids. Medical providers say most of the procedures banned in the bill are reversible and safe for minors. Transgender medical treatments for children and teens have been available in the U.S. for more than a decade and are endorsed by major medical associations.
But supporters of the legislation have contended such care is not reversible or carries side effects that only an adult — and not a minor’s parent — can consent to.

Lawmakers also banned gender-transition surgeries for minors in the state, though hospital representatives in Indiana told lawmakers doctors do not perform genital surgeries for minors or provide them surgery referrals.”

House Republicans Seek To Shield Kids From Talk About Gender, Sexual Orientation

“A new proposal from congressional Republicans would define sexually-oriented material as “any topic involving gender identity, gender dysphoria, transgenderism, sexual orientation, or related subjects.” The bill, introduced by Rep. Mike Johnson (R–La.) and co-sponsored by 33 Republican members of Congress, is called the “Stop the Sexualization of Children Act.”
Its purpose is to stop schools, libraries, and other institutions from exposing children under 10 years old to those topics, as well as preventing discussions or depictions of other sexually-oriented themes. It would do so by allowing civil lawsuits from parents if federal funds were used to facilitate such discussions. It would also block federal funding for “any program, event, or literature” involving such topics, whether at a school, a museum, a library, or any other institution. And it would also ban all federal funds for institutions with more than one violation in a five-year period.”

“the truly radical side here is the one that wants “any topic involving gender identity, gender dysphoria, transgenderism, sexual orientation, or related subjects” to be off limits for kids.

There are certainly inappropriate ways to discuss these issues with young people, but there are also age-appropriate ways to do so. And it’s safe to assume such subjects may come up organically, without being a part of officially sanctioned curriculum.

Some kids will have gay or transgender parents or relatives. They may even have transgender classmates. And television, movies, and, pop culture are full of depictions of same-sex couples and discussions of gender identity. Kids will have questions about these things, and what are teachers, guidance counselors, and librarians supposed to do when they come up—simply say “we don’t talk about that”?”

“Johnson’s bill would open up schools, libraries, and other institutions to a bevy of lawsuits, since it creates a private right of action for parents “against a government official, government agency, or private entity” if a child under age 10 was “exposed to sexually-oriented material funded in part or in whole by Federal funds.”

Again, there’s something of a bait and switch going on here. Republicans can claim it’s just about not funding certain activities. Meanwhile, it’s inviting parents to sue if a grade school library that has received any money from the federal government includes any books with gay or trans characters.

The bottom line is that the “Stop the Sexualization of Children Act” is being promoted as a way to ensure federal money isn’t funding nude drag queen shows for kids, or programs centered on sexually-oriented content for children. But it’s actually broad enough to ban funds and allow lawsuits for a range of programs—like school libraries or age-appropriate sex education curriculum—that acknowledge sexual orientation or gender identity at all.”
