“The IEA predicts that within the next three decades, two-thirds of the world’s homes could have air conditioners. About half of these units will be installed in just three countries: India, China, and Indonesia. The extent to which these new air conditioners will exacerbate climate change hinges on replacing the cooling tech we currently use with something better. Right now, ideas range from retrofitting our windows to more far-out concepts, like rooftop panels that reflect sunlight and emit heat into space. To succeed, however, the world will need to boost the efficiency of the appliances we already have — as quickly as possible — and invest in new tech that could avoid some of AC’s primary problems.
The AC’s noxious environmental impact stems from its core technology: vapor compression. This tech involves several components, but it generally works by converting a refrigerant that’s stored inside an AC from a liquid to a gas, which allows it to absorb heat, removing it from a room. Vapor compression uses an immense amount of electricity on the hottest days, and there are growing concerns that the technology might eventually overwhelm the grid’s capacity to provide power. And hydrofluorocarbons, the chemical refrigerants that many ACs use to soak up heat, are greenhouse gases that trap lots of heat in our atmosphere when leaked into the air. The challenge is that, for now, vapor compression ACs are still a critical tool during deadly heat waves, especially for high-risk populations, young children, older adults, and people with certain health conditions.
Technology to build cleaner, more efficient air conditioners does exist. Two major AC manufacturers, Daikin and Gree Electric Appliances, shared the top award at last year’s Global Cooling Prize, an international competition focused on designing climate-friendly AC tech. Both companies created ACs with higher internal performance that used less environmentally damaging refrigerants; the new units could reduce their impact on the climate by five times. These models aren’t yet on the market — Gree plans to start selling its prototype in 2025, and Daikin told Recode that it hopes to use the new technology in future products — but the IEA estimates that using more efficient ACs could cut cooling’s environmental impact by half.
Another strategy is to double down on heat pumps, which are air conditioners that also work in reverse, using vapor compression to absorb and move heat into a home, instead of releasing it outside. Heat pumps usually cost several thousand dollars”

Farmers often use the money to buy and plant cover crops. These are plants, such as clover, radishes, or rye, that are rooted in fields that might otherwise be fallow to improve the health of the soil and prevent erosion. The idea is that the ground is always “covered” with something.
Cover crops also have a range of other superpowers, said Rob Myers, director of the Center for Regenerative Agriculture at the University of Missouri. During a drought, for example, they can lock moisture in the soil; during a flood, meanwhile, they help water more easily penetrate the ground.”

And then there’s nuclear power. Viewed strictly through the lens of climate change, nuclear power can claim to be a green dream.
Unlike coal or natural gas, nuclear plants do not produce direct carbon dioxide emissions when they generate electricity, and over the past 50 years they’ve reduced CO2 emissions by nearly 60 gigatonnes. Unlike solar or wind, nuclear plants aren’t intermittent, and they require significantly less land area per megawatt produced. Unlike hydropower — which has reached its natural limits in many developed countries, including the US — nuclear plants don’t require environmentally intensive dams.
As accidents at Chernobyl and Fukushima have shown, when nuclear power goes wrong, it can go really wrong. But newer plant designs reduce the risk of such catastrophes, which themselves tend to garner far more attention than the steady stream of deaths from climate change and air pollution linked to the normal operation of conventional power plants.”

Environmental Protection Agency that it “is a major questions case.” As such, the Court ruled 6–3 that the Environmental Protection Agency (EPA) did not have clear authority from Congress to regulate the entire U.S. electric power production industry through exercising “unheralded power representing a transformative expansion of its regulatory authority in the vague language” in a rarely used section of the Clean Air Act. This decision will likely curtail future efforts by the Biden administration to significantly cut the emissions of carbon dioxide from fossil-fuel-burning power plants that contribute to man-made global warming.”

“So what is the major questions doctrine? “The Supreme Court has declared that if an agency seeks to decide an issue of major national significance, its action must be supported by clear statutory authorization,” explained the Congressional Research Service in a recent analysis. Certainly, the huge costs imposed by new regulations that are not clearly authorized by Congress would seem to qualify as an issue of national significance. In fact, in his majority opinion, Chief Justice John Roberts notes, “EPA’s own modeling concluded that the rule would entail billions of dollars in compliance costs (to be paid in the form of higher energy prices), require the retirement of dozens of coal-fired plants, and eliminate tens of thousands of jobs across various sectors.””

“In her dissent, Associate Justice Elena Kagan counters by pointing out the Obama administration’s EPA calculated that by 2030 the annual public health and climate benefits of proposed regulations under its Clean Power Plan would be between $34 to $54 billion while the costs would amount to $8.4 billion. While electricity would cost more, consumers would save $7 monthly on their electric bills due to increased energy efficiency. A 2016 study in the journal PLOS One similarly found that the health co-benefits outweighed the costs incurred from reducing carbon dioxide emissions.
Despite the fact that the benefits of costly and transformative regulations might outweigh their costs that still does not mean for the Court’s majority that their issuance is not a major question requiring clear direction from Congress before going forward.
“Capping carbon dioxide emissions at a level that will force a nationwide transition away from the use of coal to generate electricity may be a sensible ‘solution to the crisis of the day,'” concludes Chief Justice Roberts. “But it is not plausible that Congress gave EPA the authority to adopt on its own such a regulatory scheme in [the Clean Air Act]. A decision of such magnitude and consequence rests with Congress itself, or an agency acting pursuant to a clear delegation from that representative body.””
“Global known reserves of natural gas would last nearly 50 years at current rates of consumption. Burning natural gas to generate electricity emits about half of the carbon dioxide that coal does. This is why many environmental activist groups a little more than a decade ago hailed natural gas as “the bridge to the clean energy future.”
In fact, the mostly market-driven switch from coal to natural gas to generate electricity in the U.S. has served as a bridge to a cleaner energy future. The replacement in the U.S. of coal-fired power plants by those fueled by natural gas is responsible for a 32 percent reduction since 2005 in carbon dioxide emissions from that sector. Overall, annual U.S. carbon dioxide emissions have fallen by around 23 percent since 2005. Despite the undeniable role that the switch from coal to natural gas has played in significantly reducing U.S. carbon dioxide emissions, many environmental activists now perplexingly denounce natural gas as a “bridge to nowhere.””

“What about nuclear power? The fact that splitting atoms to generate electricity produces no greenhouse gas emissions should be enough to establish nuclear power as a “climate-friendly” energy technology. Last week, the International Energy Agency released a report arguing that global nuclear power capacity needs to double from 413 gigawatts now to 812 gigawatts by 2050 in order to meet greenhouse gas emissions targets set in international agreements addressing the problem of man-made climate change. Meanwhile, in response to pressure from environmental activists, Germany is going in the opposite direction, shutting down perfectly good nuclear power plants while firing up electricity generation fueled by coal.
The ecomodernist Breakthrough Institute has just released a new study setting out various scenarios of how the development and deployment of advanced nuclear reactors in the U.S. could unfold over the next 30 years. In the optimistic scenario, U.S. nuclear power generation capacity would rise from 95 gigawatts from conventional nuclear plants today to as much as 470 gigawatts generated by advanced reactors in 2050. Expanding nuclear power production would both help smooth out the intermittency of wind and solar generation and further cut climate-warming greenhouse gas emissions.”

Such rules would now require Congress to specifically create laws to implement them, and given the difficulty of passing any federal legislation, it would drastically impair the EPA’s ability to regulate the pollution that’s heating up the planet.”

“West Virginia v. Environmental Protection Agency strikes down a federal environmental regulation of power plants that never took effect, that the Biden administration has no intention of reinstating, and that would have accomplished absolutely nothing even if it had be enforced.
Nevertheless, the Court voted along ideological lines to strike down this regulation that the EPA drafted under authority granted by the Clean Air Act, claiming that it amounts to an “extraordinary” overreach by the EPA. And their decision has enormous implications both for the environment and for the federal government more broadly.
At the very least, the West Virginia decision strips the EPA of its authority to shift energy production away from dirty coal-fired plants and toward cleaner methods of energy production — although market forces have thus far accomplished much of this shift on their own, because coal-fired plants are often more expensive to operate than cleaner plants. The decision could also lead to additional limits on the EPA’s ability to regulate that industry going forward.
The West Virginia decision confirms something that has been implicit in the Supreme Court’s recent decisions governing federal agencies’ power to issue binding regulations under authority granted by Congress: When a majority of the Supreme Court disagrees with a regulation pushed out by a federal agency, the Court has given itself the power to veto that regulation — and it will do so by invoking something known as the “major questions doctrine.”
Under this doctrine, the Court explained in a 2014 opinion, “we expect Congress to speak clearly if it wishes to assign to an agency decisions of vast ‘economic and political significance.’” Thus, if a majority of the Court deems a regulation to be too significant, it will strike it down unless Congress very explicitly authorized that particular regulation.
This doctrine comes from nowhere. Last week, the Court said that abortion is unprotected by the Constitution — leaning heavily on the fact that abortion is not mentioned in the Constitution. But the the major questions doctrine is also mentioned nowhere in the Constitution. Nor can it be found in any statute. The justices made it up. And, at least during President Joe Biden’s administration, the Court has wielded it quite aggressively to veto regulations that the Court’s conservative majority finds objectionable.
Roberts’s majority opinion in West Virginia does put some flesh on the fairly bare bones the justices have previously used to describe when they will declare something to be a “major question.” Roberts faults the EPA for issuing a novel kind of regulation pursuant to a “long-extant” statute that had not previously been used to justify similar actions. He claims that the EPA relied on an “ancillary provision” of the Clean Air Act, rather than a more central provision of that law. And he criticizes the EPA for issuing a regulation which resembles bills that Congress previously considered but did not enact.
But these judgments are divorced from the text of the Clean Air Act itself. And Roberts admits that the major questions doctrine can nuke a regulation even when there is a “colorable textual basis” supporting that regulation — that is, when the actual words of a federal law could support the action taken by a federal agency.
The bottom line after the West Virginia decision is that agencies may still exercise regulatory authority, but only subject to a judicial veto. The Supreme Court has effectively placed itself at the head of much of the executive branch of the federal government.”
